1. Acceptance of Terms

Welcome to Kiddytales! These Terms and Conditions ("Terms") govern your access to and use of the Kiddytales mobile application ("App"), website, and related services (collectively, the "Service") operated by Kiddytales ("we," "us," or "our").

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a minor child, you represent that you are the parent or legal guardian of that child and accept these Terms on their behalf.

2. Eligibility

Age Requirements

  • Kiddytales is rated 4+ and designed for families with children of all ages.
  • Children under 13 should use the Service under parental supervision and with parental consent.
  • Parents and guardians are responsible for monitoring their children's use of the Service.
  • By creating an account, you confirm that you are a parent, guardian, or authorized family member.

Account Responsibility

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use of your account.

3. Description of Service

Kiddytales is a family-oriented storytelling platform that provides:

  • Personalized stories for children
  • A Story Builder feature allowing users to create custom stories with selected characters and themes
  • A library of curated stories appropriate for various age groups
  • Interactive features including reading progress tracking, quizzes, and gamification elements
  • Audio narration for stories

4. Subscriptions and Payments

Subscription Plans

  • Kiddytales offers both free and premium subscription plans.
  • Premium features, including unlimited story generation and additional content, require a paid subscription.
  • Subscription details, pricing, and features are displayed within the App prior to purchase.

Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan).
  • Payment will be charged to your Apple App Store or Google Play Store account upon confirmation of purchase.
  • Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period.

Cancellation and Refunds

  • You may cancel your subscription at any time through your device's app store settings.
  • Cancellation takes effect at the end of the current billing period; you will retain access to premium features until then.
  • Refunds are handled according to Apple App Store or Google Play Store policies. We do not directly process refunds for in-app purchases.

Price Changes

  • We reserve the right to modify subscription pricing at any time.
  • Price changes will not affect your current billing period but will apply upon renewal.
  • We will provide reasonable notice of any price increases.

Free Trials

  • We may offer free trial periods for premium subscriptions.
  • Unless you cancel before the trial ends, you will be automatically charged for the subscription.

5. Story Builder and Rate Limits

Story Generation Limits

  • Story generation through the Story Builder feature is subject to rate limits.
  • Free users may be limited in the number of stories they can generate within a specified time period.
  • Premium subscribers receive higher or unlimited story generation allowances as specified in their subscription plan.

Content Generation

All stories generated through the Story Builder are created using curated themes and characters. We control the narrative to ensure all generated content is safe and appropriate for children.

6. Intellectual Property

Our Content

  • The Service, including its design, features, graphics, logos, and original story content, is owned by Kiddytales and protected by copyright, trademark, and other intellectual property laws.
  • You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

Generated Stories

  • Stories generated through the Story Builder are created for your personal, non-commercial use.
  • You are granted a limited, non-exclusive license to view, save, and share stories generated for your account with family members.
  • We retain ownership of the underlying technology used to generate stories.
  • You may not sell, commercially distribute, or claim exclusive ownership of generated stories.

User-Provided Content

  • You retain ownership of any content you provide (such as character names or custom inputs).
  • By providing content, you grant us a license to use it for the purpose of providing the Service to you.

7. Acceptable Use Policy

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to circumvent rate limits or other technical restrictions
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use automated systems (bots, scrapers) to access the Service
  • Share your account credentials with others or allow unauthorized access
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to generate inappropriate, harmful, or offensive content
  • Use the Service in any way that could harm minors
  • Impersonate any person or entity or misrepresent your affiliation

8. Children's Safety

Parental Responsibility

  • Parents and guardians are responsible for supervising their children's use of the Service.
  • We encourage families to read stories together and discuss content with children.

Content Appropriateness

  • While we strive to ensure all content is age-appropriate, generated content may occasionally produce unexpected results.
  • Parents should review stories, especially those created through the Story Builder, before sharing with young children.
  • If you encounter any inappropriate content, please report it to us immediately.

No Direct Communication

  • The Service does not include features for children to communicate with other users or strangers.
  • We do not knowingly collect personal contact information from children for communication purposes.

9. Disclaimers

Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Generated Content

  • Generated stories may occasionally contain errors, inconsistencies, or unexpected content.
  • We do not guarantee that generated content will meet your specific expectations or requirements.
  • We are not responsible for any decisions or actions taken based on generated content.

Service Availability

  • We do not guarantee that the Service will be uninterrupted, secure, or error-free.
  • We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

Third-Party Services

  • The Service may integrate with third-party services (such as payment processors and cloud providers).
  • We are not responsible for the availability, accuracy, or content of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • KIDDYTALES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
  • SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kiddytales and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you provide through the Service

12. Account Termination

Termination by You

  • You may delete your account at any time through the App settings or by contacting us.
  • Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, without prior notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, us, or third parties
  • Is fraudulent or illegal

Effect of Termination

  • Upon termination, your right to use the Service will immediately cease.
  • Active subscriptions are subject to the refund policies of the applicable app store.
  • Provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

  • We reserve the right to modify these Terms at any time.
  • We will notify you of material changes by posting the updated Terms in the App or by other means.
  • Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
  • If you do not agree to the revised Terms, you must stop using the Service.

14. Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kiddytales is registered, without regard to conflict of law principles.

Dispute Resolution

  • We encourage you to contact us first to resolve any disputes informally.
  • Any disputes that cannot be resolved informally shall be resolved through binding arbitration or in the courts of competent jurisdiction, as permitted by applicable law.

Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kiddytales regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
